What You Should Know Before Using the LTCareNav Service

Before using and sharing Information through our Service, you should understand the following.

• You should read our Terms of Service, which is incorporated herein.
• You should read our Consumer Health Data Privacy Disclosure, which is incorporated herein.
• Selecting a Sign-Up Button creates an account. When you select a Sign-Up Button, we create a dashboard (your account) for the email address you provide and send you a sign-in link. See "Account Creation and Sign-In" below.
• If you are in the European Economic Area, UK, or Switzerland, please take notice that our Services are not offered to users in those areas. Any of your information that we collect will be transferred to LTCareNav in the United States.

Sources and Types of Personally Identifiable Information We Collect from You

We receive and store any Information you enter in our Service or give us in any other way. We also collect certain Information automatically when you use our Service. If you choose not to provide this Information to us, you may not be able to obtain the benefits of the services as a user of our Service.

Information we collect from users of our Service includes Information that will be collected automatically using cookies and similar technologies. Cookies collect different aspects of information, including personally identifiable information. This kind of Information may include IP addresses, session information, product usage data, tracking data and other information about your use of our Service.

When you select a Sign-Up Button, complete an assessment, or register for an account, we need your email address. To allow you to use the features and functions of our Service, we will also need information about your gender and general age, and will request your name, address, telephone, your use of assistive devices, handedness, health and well-being Information, general financial information, and optionally an image of you. You will also be asked several questions during the assessment and registration process so that we can deliver information and resources to you. Providing some of that Information is voluntary on your part.

We also collect information needed to create your account and sign you in. See "Account Creation and Sign-In" below.

We also may periodically obtain Information about you from family that provided you with access to our Service. We may also receive assessment data from third parties. You may have the opportunity to provide Information of other individuals, including a family member or, if you are a Professional User, a client. When providing such Information, you are solely responsible for obtaining the necessary consents and authorizations from any individuals in accordance with applicable data security laws and regulations, including consent to share their Information with Commercial Users as described in this Privacy Policy and our Terms of Service, and we shall not be responsible or held liable for your failure to obtain the necessary consents and authorizations.

This Policy does not apply to information collected by us offline or through any other means, including on any other website operated by a third party, or information collected by any third party through any application or content (including advertising) that may link to or be accessible from the Services.

We may also collect personally identifiable information that may be considered "Consumer Health Data" under applicable state consumer health data privacy laws. If you are a resident of Nevada or Washington, please see our Consumer Health Data Privacy Disclosure for more information.

Account Creation and Sign-In

Accounts. When you select a Sign-Up Button (for example, "Get My Free Ebook," "Get My Results," or "Get My Free PDF Download"), we create an LTCareNav account for you (your dashboard) for the email address you provide, and we send a sign-in link to that email address. You do not need to choose a password. You may also create an account by registering on our website.

Sign-in links (magic links). Each sign-in link works only once, expires one hour after we send it, and works only in the browser in which you requested it. To create your account and operate sign-in, we collect and use your email address and information about each sign-in, such as the time a link was sent and used, a unique sign-in token, and technical information about the browser and device used to request and open the link (for example, IP address and browser type). We use this information to deliver sign-in emails, confirm that a link is used in the browser that requested it, keep your account secure, prevent fraud and unauthorized access, and maintain your account.

Your email address controls your account. Anyone who can open the email account on file may be able to request and use a sign-in link to access your LTCareNav account, including your assessment results and care information. Please use an email address that you own and that only you can access, and do not forward sign-in links. See Sections 8 and 9 of our Terms of Service. If you did not request an account, or you believe someone has accessed your account without permission, contact us at privacy@LTCareNav.com.

Professional Users. Professional Users do not sign in with sign-in links. If a Professional User completes an assessment for a client, the account is created at the email address entered, and the Professional User is responsible for having the client's authorization to submit the client's Information.

How We Use Your Information

LTCareNav uses the Information we collect about you for registration and to manage your account, to sign you in and keep your account secure, to communicate with you, and to connect you with resources and appropriate providers and professionals. We will also use your Information to allow those providing the Service to you to have the information necessary to answer your questions and to respond to your requests.

We may use your Information as defined in the Terms of Service and to provide and/or improve the Service. We may use your Information in an anonymized manner to develop additional products and services or to measure and improve our products and services and to develop or improve third party products and services.

We may use automatically collected information, including through cookies, to: (i) conduct analyses about our Services; (ii) associate the different devices you use; (iii) remember your browser or device; (iv) remember your preferences and interactions; (v) deliver relevant advertisements or other content; (vi) market our Services to you; and (vii) log activity on our Services. We do not use Consumer Health Data for advertising or marketing to you without your consent.

We use your Information when you authorize us to use it and when it is necessary to enforce this Privacy Policy and our Terms of Service. These purposes may include the following:

• for registration and to manage your account, including to facilitate your access to and use of our Service, and to send sign-in links and keep your account secure;
• to communicate with you and respond to your questions and comments;
• to enable us to deliver our products and services to you;
• to resolve disputes or troubleshoot problems;
• to prevent prohibited or illegal activities;
• to enforce our Terms of Service and Privacy Policy;
• to contact you with special offers and other information we believe will be of interest to you (in accordance with any privacy preferences you have expressed to us);
• to connect you with Commercial Users and other providers and share your Information with them as described in "How We Connect You with Commercial Users" below;
• to comply with a legal obligation such as court orders, or other legal process; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law;
• to respond as required for a corporate transaction, such as a divestiture, investment, merger, consolidation, or asset sale, or other significant matter.

How We Connect You with Commercial Users

When you use the Service, we connect you with Commercial Users based on your care needs and location. As part of this process, we may share your contact information and a general overview of your care needs with the Commercial Users we connect you with so that they may follow up with you. This may occur through automated means, including AI-assisted matching (see "Use of Artificial Intelligence" below). You do not need to separately accept each connection. Once we share your Information with a Commercial User, that Commercial User's own privacy practices apply to its use of it.

You may withdraw your authorization to share your Information at any time by emailing privacy@LTCareNav.com. Withdrawing does not affect Information we shared before we received your request, and it may limit our ability to provide matching or introduction features to you.

Washington residents. If you live in Washington, we ask for your separate consent before we share your consumer health data with Commercial Users. Agreeing to our Terms of Service or this Privacy Policy is not that consent. See our Consumer Health Data Privacy Disclosure.

Use of Artificial Intelligence

We use artificial intelligence, machine learning models, and related automated technologies ("AI") to support certain features of our Service, including generating content, summarizing information, powering conversational features, and assisting with search or matching functionality. AI may be provided by LTCareNav directly or by third-party vendors whose technology we incorporate into the Service.

When you submit Information to an AI-powered feature, that Information may be processed by LTCareNav and by the third-party AI vendor(s) supporting that feature, in order to generate the relevant content, response, or match. We require our third-party AI vendors to protect the confidentiality and security of the Information we share with them, consistent with the agreements described in "How We Disclose Your Information" below.

We do not use the Information you submit to AI-powered features to train or fine-tune any third-party AI vendor's models for the benefit of other parties.

AI-assisted features, including AI-assisted matching, may be used to identify and suggest Commercial Users or other providers that may be relevant to your care needs and location. As described in our Terms of Service and in "How We Connect You with Commercial Users" above, this may involve sharing your contact information and a general overview of your care needs with one or more Commercial Users so that they may follow up with you. AI-generated outputs are provided for convenience and are not a substitute for your own judgment or independent evaluation.

Retention of Information processed by AI-powered features is governed by the "Retention Periods and Deletion" section below.

How We Disclose Your Information

We disclose your Information to family members, professionals, and providers (including Commercial Users) as described in "How We Connect You with Commercial Users" above and to the extent that you choose to share or invite others through our Service. Those recipients can see only the Information needed to help you with your problem or need, as requested by you and as determined by our system.

We may disclose aggregated data and high-level information in a way that does not identify individuals.

We do disclose your Information for processing and storage with third parties that have agreements in place with us to protect the confidentiality and security of information that we transfer to them. This includes third-party AI vendors that process Information on our behalf to support AI-powered features, as described in "Use of Artificial Intelligence" above, and the service provider that sends our sign-in emails.

We may disclose your personally identifiable information for lawful purposes, including in the following situations:

• We believe that disclosure is reasonably necessary to comply with any applicable law, regulation, subpoena, or court order;
• To respond to duly authorized information requests from law enforcement or other governmental authorities;
• To enforce our agreements or policies;
• To investigate and prevent security threats, fraud, or other malicious activity; or
• To respond to an emergency that we believe in good faith requires us to disclose such information to assist in preventing the death or serious bodily injury of any person or an LTCareNav employee.

There are circumstances where we may decide to buy, sell, or reorganize our business. Under these circumstances, it may be necessary to disclose or receive personally identifiable information with prospective or actual purchasers, acquisition targets, partners or affiliates. In such circumstances, we will ensure your information is used in accordance with this Privacy Policy.

Your European Privacy Rights

While we do not provide services to or market the Service to those who reside in the Europe Economic Area (the "European Union" or "EU"), we will provide accommodations for the exercise of your rights provided under data protection laws of the EU, including the General Data Protection Regulation (the "GDPR").

If you are entitled to privacy rights under the GDPR, you are entitled to:

Transparency and the right to information. Through this Privacy Policy we explain how we use and disclose your information. However, if you have questions or concerns you can contact us any time.

Right of access, objection, restriction of processing, erasure, and portability. You also have the right to withdraw your consent at any time when we process your personal data based on your consent. To exercise these rights, please email: privacy@LTCareNav.com.

Right to opt-out to direct marketing. You have the right to opt-out at any time to receiving marketing materials from us by following the opt-out instructions in our commercial emails, by contacting us, or by adjusting your preferences on the Service. Please note that we reserve the right to send you other communications, including service announcements, sign-in emails, and administrative messages relating to your LTCareNav account, without offering you the opportunity to opt out of receiving them.

Right not to be subject to an automated decision, including profiling. We do not make automated decisions using your personal data that would produce legal effects concerning you or similarly significantly affect you without an opportunity for human review. AI-assisted features described in "Use of Artificial Intelligence" above may suggest matches or content based on your Information, but final decisions about acceptance, services, and pricing remain with you and the relevant Commercial User, as described in our Terms of Service. We use cookies and similar technologies in our Service to personalize your experience of our Service.

Right to lodge a complaint with a supervisory authority. If you consider that the processing of your personal data infringes your privacy rights according to the European Data Protection law, you have the right to lodge a complaint with a supervisory authority, in the member state of your habitual residence, place of work, or place of the alleged infringement.

Your Preferences

From time to time, we may send you email newsletters and marketing emails. You may opt out of them at any time by selecting the "unsubscribe" link at the bottom of each email. Please note that by opting out or unsubscribing you may affect other services you have requested we provide to you, in which email communication is a requirement of the service provided. Even if you opt-out of receiving marketing material, we may still need to contact you with important information about your account or responding to your requests or questions. Sign-in emails and password reset emails are service communications that we need to send to operate your account, and they are separate from marketing emails.

Our Services may use Facebook Connect, Google Analytics, Google Audiences, Meta, and others for audience measurement and analytics purposes. These analytics services may use cookies or similar technologies to collect information to help us analyze users and how they use our Services. The Information collected by these technologies is used to assess how often you visit our Services, what pages you view when you visit our Services, and what other websites you visited before coming to our Services. Information generated by these services may be transmitted to and stored by these providers and they may use this Information for purposes such as evaluating your use of our Services, compiling statistics reports on the Services' activity, and providing other services relating to our Services activity and other internet usage. You may review Google's data privacy practices for Google Analytics and data privacy practices for Google Tag Manager. To opt out of being tracked by Google Analytics, you may download and install the Google Analytics Opt-out Browser Add-on.

Of course, if you do not wish to have cookies on your devices, you may turn them off at any time by modifying your internet browser's or device's settings. Please refer to the help section of your browser or mobile device for additional information. Your browser or mobile device may also offer add-ons, plugins, or extensions to manage cookies, local storage objects, scripts, or similar technologies mentioned in this Privacy Policy. Apple and Android mobile devices each generate an advertising identifier that can be accessed by apps and used by advertisers in much the same way that cookies are used on websites. Each operating system provides options to limit tracking and/or reset the advertising ID. However, by disabling cookies on your browser or device, you may be prohibited from full use of the Services' features or lose access to some functionality.

Nevada law permits customers in Nevada to opt-out of the sale of certain kinds of personally identifiable information. We do not sell your personally identifiable information to third parties as defined under Nevada law. Your California Privacy Rights

California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please email: privacy@LTCareNav.com.

Do Not Track Technologies

Some browsers may have settings to request that websites "Do Not Track" your activity or usage. At this time, we do not use services that will accommodate these technologies and your requests may not be able to be honored on our Service. We do use cookies and other technologies to track your usage and other information about your visit to our Service.

Retention Periods and Deletion

LTCareNav retains your Information to the extent necessary to reasonably provide the Services and the Service requirements, to meet our compliance and legal obligations, to enhance security and fraud prevention, and for audit purposes. We will keep your Information while you have an account and in accordance with our Terms of Service.

Closing your account. If you did not intend to create an account, or you no longer want one, you may close it at any time by emailing privacy@LTCareNav.com. After you close your account, we will delete or de-identify your Information within forty-five (45) days, except that we may keep Information as needed to meet legal obligations, enhance security and prevent fraud, resolve disputes, and for audit purposes. We will also notify the Commercial Users and other third parties with whom we shared your Information of your request so that they can delete it too, although we cannot control their records. If you are a Nevada or Washington resident, see our Consumer Health Data Privacy Disclosure for your additional rights. Sign-in emails will stop once your account is closed.

How We Protect Your Personal, Health, and Financial Information

We want you to feel confident about using our Service, and we are committed to protecting the personally identifiable information we collect. While no website can guarantee security, we have implemented appropriate administrative, technical, and physical security procedures to help protect the personally identifiable information you provide to us. For example, only authorized employees are permitted to access personally identifiable information of users and they only may do so for permitted business functions. Our security and privacy policies are periodically reviewed and enhanced as necessary, and only authorized personnel have access to personally identifiable information that you have provided to us. Our sign-in links are single-use, expire after one hour, and work only in the browser in which they were requested. You should bear in mind that submission of Information over the Internet is never entirely secure. We cannot guarantee the security of Information you submit via our Service while it is in transit over the Internet, and any such submission is at your own risk.

You are responsible for keeping your email account secure, because anyone who can open it may be able to access your LTCareNav account. Please do not forward sign-in links. Please notify us immediately of any actual or suspected unauthorized use of the Services, your account, or your Information.

Children's Privacy

The Service is not a general audience service and does not offer services directed to individuals under 18 years of age. No one under the age of 18 may provide any Information to our Service. We do not knowingly collect personally identifiable information from individuals under 18. If you are under 18, do not use or provide any Information on our Service or on or through any of its features, do not register on our Service, use any of the features of the Service, or provide any Information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. Should an individual whom we know to be under the age of 18 sends personally identifiable information to us, we will delete or destroy it as soon as reasonably possible. If you believe we might have personally identifiable information, contact us.

Information about International Transfers

If you are using our Service from outside the United States, please be aware that your Information will be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. You may also be re-directed to a Service that we maintain in a different country. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country, but please be assured that LTCareNav does take steps pursuant to laws in the United States to ensure that your privacy is protected. By using our Service or using our services, you understand that your Information will be transferred to our facilities and those third parties with whom we disclose it as described in this Privacy Policy.

Changes to this Privacy Policy

LTCareNav may update this Privacy Policy in the future. We will notify you about material changes to this Privacy Policy by either sending a notice to the email address on your account and/or by placing a prominent notice on the Service, and we will update the "Last Revised" date above. Changes go into effect on the "Last Revised" date or on a later date stated in our notice. If a change adds a new category of Consumer Health Data, a new purpose, or a new category of recipient, we will ask for your consent before applying it to your Consumer Health Data.
